1. Agreement to these Terms
These Terms of Use (“Terms”) govern your access to and use of the Casa Rio community website and related digital services (the “Platform”) operated by Casa Rio & Casa Rio CHS Fed. Ltd. (the “Federation”, “we”, “us” or “our”).
By accessing or using the Platform, creating an account, submitting an event registration, or using any interactive feature, you agree to these Terms.
Organisers and editors are additionally subject to the Organiser Terms. The collection and processing of personal data is described separately in our Privacy Notice.
If you do not agree to these Terms, you should not use account, registration or other interactive features of the Platform.
2. About the Platform and our role
The Platform is a community information and facilitation platform for Casa Rio and the wider Palava community.
It may provide:
- community information and updates;
- events and event listings;
- stories, articles and gallery content;
- event registration;
- organiser pages;
- administrative and community tools; and
- other features introduced from time to time.
Features may be added, modified, restricted, suspended or discontinued as reasonably necessary for operational, security, legal or community requirements.
Unless expressly stated otherwise:
- information published on the Platform is for general community information and does not replace any formal notice, circular, resolution or statutory communication required to be issued by a cooperative housing society, the Federation or any competent authority;
- use of the Platform does not create an employment, partnership, joint venture or agency relationship with the Federation;
- individual cooperative housing societies remain responsible for their own statutory obligations, records, decisions and society-level communications; and
- publication of third-party or organiser content does not imply endorsement, verification or approval by the Federation.
Where an event or activity is organised independently by a community organiser, the Federation’s role may be limited to providing listing, communication or registration facilities.
3. Eligibility and accounts
You must be at least 18 years of age to independently create and operate an account.
Where the Platform permits participation or registration by a person below 18 years of age, it may require the involvement, authorisation or consent of a parent or lawful guardian, as appropriate to the activity and applicable law.
Sign-in may be provided through mobile OTP or another authentication mechanism.
Accounts are personal and non-transferable. You must:
- provide accurate and current information;
- keep your device, OTP and login credentials secure;
- not share an OTP or authenticated account with another person;
- not impersonate another person; and
- promptly inform us if you suspect unauthorised access or misuse.
You are responsible for activity carried out through your authenticated account except to the extent resulting from circumstances outside your reasonable control.
We may restrict or suspend access where we reasonably believe that these Terms or applicable law have been breached, or where necessary for security, maintenance, protection of users or proper operation of the Platform.
4. Events and registrations
The Platform may enable users to discover or register for community events.
When you register for an event, you must provide information that is accurate and complete.
Personal information submitted during registration will be handled for the purposes described at the point of collection and in the Privacy Notice, in accordance with applicable data-protection law.
Organiser applications
A person or group may apply to become a standing organiser through the Platform.
Submitting such an application does not appoint the applicant as an organiser or provide publishing rights. Organiser access is granted only after approval by the Federation and is governed by the Organiser Terms.
Participation
Registration for an event does not guarantee participation.
Participation may be affected by:
- capacity;
- eligibility requirements;
- safety considerations;
- weather;
- venue availability;
- permissions;
- programme requirements; or
- other reasonable operational circumstances.
An event may be cancelled, postponed, relocated or modified by the relevant organiser or, where appropriate, by the Federation.
Where registration information is available to us, reasonable efforts may be made to communicate material changes to registered participants.
Independent events
Unless an event is expressly identified as a Federation event, it may be independently organised by the organiser identified on the event listing.
Publication or registration of such an event through the Platform:
- does not make the Federation its organiser, promoter or operator;
- does not create a partnership or agency between the Federation and the organiser; and
- does not constitute permission to use any venue, common area or Federation facility.
The organiser remains responsible for conducting its event in accordance with applicable law, permissions and venue requirements.
5. Participation in physical activities
Participation in sporting, recreational, cultural and other physical activities may involve ordinary risks associated with the relevant activity.
Participants are responsible for:
- considering whether an activity is suitable for them;
- complying with reasonable safety and venue instructions;
- disclosing information where specifically required for safe participation;
- supervising children accompanying them where applicable; and
- taking reasonable care of themselves, their belongings and other participants.
The Platform itself does not provide medical, fitness, childcare or professional safety services.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
6. Photographs and community documentation
Photographs or videos may be taken at community events for legitimate community purposes, including documentation, event reporting, galleries, stories and community communications.
Where photography or recording is undertaken by the Federation, information or notices may be provided where appropriate to the nature of the event.
Where consent or another legal basis is required under applicable data-protection law, the relevant requirements will apply.
Where children are identifiable, additional precautions, permissions or restrictions may apply.
If you have a concern regarding an identifiable photograph or video under the Federation’s control, you may contact the helpdesk at +91-89768-58001. We will consider reasonable requests for review, restriction or removal having regard to the circumstances, community purpose and applicable law.
Organisers remain responsible for photographs and recordings independently collected or used by them, subject to the Organiser Terms and applicable law.
7. Acceptable use
You must use the Platform lawfully and responsibly.
You must not:
- attempt unauthorised access to the Platform, another account or restricted information;
- probe, attack, interfere with or circumvent Platform security;
- knowingly introduce malware, malicious code or harmful software;
- use automated tools in a manner that materially interferes with Platform operation;
- submit false, fraudulent or materially misleading information;
- impersonate another person, society, organisation, authority or the Federation;
- publish or transmit unlawful, defamatory, obscene, threatening, hateful, discriminatory or harassing material;
- infringe copyright, trademark, privacy, publicity or other third-party rights;
- scrape, harvest or systematically extract personal information;
- collect or use resident or participant information without lawful authority;
- send spam or unrelated commercial solicitations;
- use the Platform for campaigning for or against a political party, candidate or electoral cause without express permission;
- use the Platform in a manner likely to threaten safety, public order or communal or social harmony; or
- otherwise use the Platform for an unlawful purpose.
Non-partisan civic, public-awareness and community-interest activities may be permitted in accordance with applicable Platform and organiser rules.
Where reasonably necessary, we may remove or restrict access to material that appears to breach these Terms or applicable law and may preserve relevant records where required for security, investigation or legal compliance.
8. User and organiser submissions
Where the Platform enables you to submit text, photographs, artwork, feedback, registration information or other content, you remain responsible for what you submit.
You represent that:
- you have the right or authority to submit the material;
- the submission does not knowingly violate applicable law or third-party rights; and
- information presented as factual is not knowingly false or materially misleading.
For material intended for publication or display, you grant the Federation a non-exclusive, royalty-free licence to host, store, reproduce, display, format and technically adapt that material to the extent reasonably necessary to operate the Platform and fulfil the community purpose for which it was submitted.
This licence does not transfer ownership of your content to the Federation.
Additional provisions apply to organiser content under the Organiser Terms.
Feedback and suggestions concerning the Platform may be used to improve the Platform without obligation to compensate the person providing them.
9. Intellectual property
Except for content belonging to users, organisers or third parties, the Platform and its original design, software, text, graphics, logos, branding and other materials are owned by or licensed to the Federation.
You may access and use Platform content for personal and legitimate community purposes.
Unless authorised by the Federation or the relevant rights holder, you must not commercially exploit, reproduce, republish, frame or systematically redistribute protected Platform content.
The names, logos and branding of the Federation, Casa Rio and participating organisations must not be used in a manner that falsely suggests sponsorship, endorsement or affiliation.
10. Third-party services and links
The Platform may rely on third-party technology, hosting, authentication, communication, storage, analytics or other service providers.
It may also contain links to external websites, forms, payment facilities or registration services operated by third parties.
Third-party services may be subject to their own terms and privacy practices. The Federation is not responsible for matters outside its reasonable control arising solely from independent third-party services.
Where a third-party service provider processes personal data on behalf of the Federation, the Federation’s responsibilities will be governed by applicable data-protection law and the Privacy Notice.
11. Information Technology Act and intermediary functions
To the extent that the Federation receives, stores, transmits or hosts information provided by third parties in circumstances where it qualifies as an intermediary under the Information Technology Act, 2000, the applicable provisions of that Act and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended, will apply.
The Federation may remove, restrict or disable access to content where required by applicable law, a competent court, authorised government direction, or applicable intermediary due-diligence requirements.
Nothing in this section limits the Federation’s responsibility for content authored and published by it in its own capacity.
12. Privacy and data protection
Our collection and processing of personal data is described in the Privacy Notice.
Personal data may be collected when you:
- create or access an account;
- register for an event;
- submit an organiser application;
- communicate with the Federation;
- submit a form, request or grievance; or
- use another feature requiring personal information.
Where consent is required by applicable data-protection law, it will be sought through an appropriate affirmative action in connection with a stated purpose.
Merely browsing publicly available portions of the Platform does not, by itself, constitute consent to unrelated processing of personal data.
The Digital Personal Data Protection Act, 2023, the Digital Personal Data Protection Rules, 2025, and other applicable data-protection requirements will apply to the extent and from the dates on which their respective provisions are legally in force.
Users must not impersonate another individual, submit another person’s personal information without lawful authority, or knowingly provide false information in connection with authentication or registration.
13. Community information and disclaimers
The Platform is provided on an “as available” basis.
We aim to maintain accurate and useful community information but do not guarantee that:
- every page will always be available;
- information supplied by third parties will always be complete or error-free;
- events will proceed exactly as originally listed; or
- the Platform will operate without interruption.
Community posts, organiser content, drafts, informal updates and general informational material should not be treated as a substitute for formal legal, medical, financial, engineering, structural, safety or other professional advice.
Where information is important for legal, financial, safety or statutory purposes, users should verify it through the appropriate official source.
Nothing in these Terms excludes warranties, duties or remedies that cannot lawfully be excluded.
14. Limitation of liability
To the fullest extent permitted by applicable law, the Federation and its office-bearers, committee members, employees, authorised volunteers and agents will not be liable for indirect, incidental, special or consequential loss arising solely from use of, or inability to access, the Platform.
Without limiting the above, the Federation is not responsible for loss resulting solely from:
- acts or omissions of independent event organisers;
- acts of other participants;
- third-party vendors or venue operators;
- event changes outside the Federation’s control;
- failure of telecommunications or third-party technology infrastructure; or
- unauthorised acts by third parties despite reasonable security measures.
Where the Federation itself organises an event or directly undertakes an obligation, responsibility will be determined according to the applicable circumstances and law.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct or any other liability that cannot lawfully be excluded or limited.
15. Indemnity
Where your breach of these Terms, unlawful conduct, misuse of the Platform, infringement of third-party rights, or unauthorised use of another person’s information results in a third-party claim against the Federation, you agree, to the extent permitted by law, to indemnify the Federation and its office-bearers against the resulting loss, liability and reasonable legal costs.
This indemnity does not apply to the extent that the claim or loss was caused by the Federation’s own wrongful act.
Organisers are additionally subject to the indemnity and responsibility provisions contained in the Organiser Terms.
16. Force majeure
The Federation will not be liable for delay, interruption or inability to provide a Platform feature due to circumstances beyond its reasonable control, including:
- natural disasters;
- flood or fire;
- epidemic or public-health emergency;
- war or civil disturbance;
- governmental action;
- power or telecommunications failure;
- major third-party infrastructure failure; or
- venue or facility unavailability beyond its reasonable control.
This clause does not affect obligations that cannot lawfully be excluded.
17. Suspension and termination
We may suspend, restrict or terminate access to the Platform or a particular feature where reasonably necessary for:
- breach of these Terms;
- suspected fraud or misuse;
- security or technical reasons;
- protection of residents or other users;
- compliance with law or lawful directions; or
- discontinuation or material restructuring of a Platform feature.
Where immediate action is required for security, safety or legal compliance, action may be taken without prior notice.
Where reasonably practicable, we may provide an opportunity to clarify or remedy the issue.
You may stop using the Platform at any time and may exercise available account and personal-data rights as described in the Privacy Notice.
Provisions which by their nature should continue after termination - including intellectual property, liability, indemnity, governing law and accrued rights - will survive termination.
18. Changes to these Terms
We may update these Terms from time to time to reflect changes in:
- Platform features;
- community requirements;
- operational practices;
- applicable law; or
- security and compliance requirements.
The “Last updated” date will be revised when the Terms change.
Where a change is material, reasonable notice will be provided through the Platform or another appropriate channel where reasonably practicable.
Continued use of the Platform after revised Terms become applicable constitutes acceptance of those Terms, except where applicable law requires a separate consent or other affirmative action.
19. Governing law and disputes
These Terms are governed by the laws of India.
Subject to any mandatory statutory jurisdiction or remedy, courts having competent territorial jurisdiction over Casa Rio, Dombivli, District Thane, Maharashtra shall have jurisdiction in relation to disputes arising from the Platform or these Terms.
Where appropriate, users are encouraged to first contact the Federation helpdesk at +91-89768-58001 so that the issue can be considered and, where possible, resolved without formal proceedings.
Nothing in this section prevents:
- urgent interim or injunctive relief;
- access to any statutory grievance mechanism; or
- proceedings before any authority or tribunal having mandatory jurisdiction under applicable law.
20. General provisions
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
No waiver: Failure to enforce a provision on one occasion does not waive the right to enforce it subsequently.
Entire framework: These Terms, the Privacy Notice, and any additional terms expressly applicable to a particular feature - including the Organiser Terms - together constitute the applicable Platform terms for that feature.
Assignment: You may not transfer your Platform rights or obligations to another person without our consent. The Federation may transfer operation of the Platform and these Terms to a lawful successor responsible for the relevant community service.
Language: The English version will prevail in the event of inconsistency with a translated version, unless applicable law requires otherwise.
